This notice explains which personal data we process when you use the English pages of our website or contact us, and what rights you have. It is a translation of the relevant sections of our privacy policy, which is available in full in German: Datenschutzerklärung. In case of doubt, the German version applies.

Our website is hosted by IONOS SE, Elgendorfer Str. 57, 56410 Montabaur, Germany, which operates it on our behalf (Art. 28 GDPR). Each time a page is accessed, the server stores the following in log files: IP address, date and time, page accessed, amount of data transferred, whether the request was successful, browser and operating system, and the page you came from. We need this data to deliver the website and to fend off attacks. The legal basis is our legitimate interest (Art. 6(1)(f) GDPR). The log files are stored until they are deleted automatically.
If you contact us via a form, by email or by phone, we use your details to answer your enquiry and to prepare an offer. Required fields are marked; without them we cannot reply. The legal basis is Art. 6(1)(b) GDPR if your enquiry is aimed at a contract, otherwise our legitimate interest in answering enquiries (Art. 6(1)(f) GDPR).
If you have given an email address, we immediately send you a confirmation of receipt with the details of your enquiry.
Forms are sent via the IONOS mail server to our mailboxes at Microsoft 365 (Microsoft Ireland Operations Limited, Dublin, Ireland, as processor). No enquiry remains stored on our web server.
To protect against spam and misuse, we check enquiries on our own server, without third-party services. To limit the number of enquiries per sender, we store an encrypted checksum of your IP address for 24 hours, from which the address cannot be read. The legal basis is our legitimate interest in protection against misuse (Art. 6(1)(f) GDPR).
We delete enquiries as soon as we no longer need them. If an enquiry leads to an order, the retention periods under commercial and tax law apply.
No cookies are needed to operate the website. We store your choice in the consent window in your browser for 12 months (Section 25(2) no. 2 TDDDG, the German Telecommunications Digital Services Data Protection Act). The consent window is our own solution on our server, without any third-party service. Google Analytics and Google Ads (sections 6 and 7) only run if you give your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). You can withdraw your consent at any time via “Cookie settings” at the bottom of every page.
On this website, data is collected for marketing, market research and optimisation purposes using SalesViewer technology from SalesViewer GmbH, Huestr. 30, 44787 Bochum, Germany, on the basis of our legitimate interest (Art. 6(1)(f) GDPR). For this purpose, a script is used that records company-related data. The data is pseudonymised by one-way encryption (hashing) and is not used to identify visitors personally. It is deleted as soon as it is no longer required for this purpose and no retention obligations prevent its deletion.
You can object to this data collection at any time: https://www.salesviewer.com/opt-out. An opt-out cookie is then stored in your browser. If you delete your cookies, please click the link again.
With your consent, we use Google Analytics from Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. Google Analytics shows us, in aggregate, how visitors use the website. For this purpose, identifiers are stored in your browser and usage data is transferred to Google. Google signals are switched off. The data is deleted automatically when the retention period set in Google Analytics expires.
With your consent, we measure whether a visit via a Google advert leads to an enquiry (Google Ireland Limited, address as in section 6). For this purpose, an identifier is stored in your browser. We only learn the number of such enquiries, not who made them. We do not use personalised advertising or remarketing.
Apart from us, your data is only received by the service providers named here, our tax adviser and public authorities where there is a legal obligation.
Microsoft and Google may transfer data to the USA. This is based on the European Commission’s adequacy decision on the EU-US Data Privacy Framework (Art. 45 GDPR), supplemented by standard contractual clauses (Art. 46(2)(c) GDPR).
Under Art. 15 to 20 GDPR, you have the right of access, rectification, erasure, restriction of processing and data portability. You can withdraw any consent you have given at any time with effect for the future. To do so, write to kontakt@herbst-gabelstapler.de or to our postal address.
Right to object: Where we process data on the basis of our legitimate interest, you may object at any time on grounds relating to your particular situation (Art. 21 GDPR). You may object to the use of your data for advertising at any time without giving reasons.
You can lodge a complaint with a supervisory authority. The authority responsible for us is the State Commissioner for Data Protection of Lower Saxony (Der Landesbeauftragte für den Datenschutz Niedersachsen), Prinzenstraße 5, 30159 Hannover, Germany.
